By redeeming, using, or attempting to redeem or use any Tune Talk points for Tune Talk Goodies, you (“Subscriber” or “you”) agree to be bound by these Terms and Conditions (“Terms”). These Terms constitute a legally binding agreement between you and Tune Talk. If you do not agree with these Terms, you are advised not to participate in the Tune Talk Goodies program. Your participation in the Tune Talk Goodies program signifies your unconditional acceptance of these Terms.
Eligibility
The Tune Talk Goodies program is available to active Tune Talk subscribers who maintain an account in good standing.
Eligibility for specific Tune Talk Goodies may be limited to subscribers on designated tariff plans (“Eligible Tariff Plans”). Tune Talk reserves the right to modify the list of Eligible Tariff Plans at any time without prior notice. The current list of Eligible Tariff Plans for each Tune Talk Goodie is available on the Tune Talk mobile application (“App”).
Redemption of Tune Talk Goodies
Subscribers may redeem Tune Talk Goodies using Tune Talk points through the Tune Talk App.
The number of Tune Talk points required for redemption of each Tune Talk Goodie is specified in the Tune Talk App and is subject to change at Tune Talk’s sole discretion.
Upon successful redemption, the corresponding number of Tune Talk points will be deducted from the Subscriber’s account.
Redemption is subject to the availability of Tune Talk Goodies. Tune Talk does not guarantee the availability of any Tune Talk Goodie at any given time.
Tune Talk Goodies Categories and Specific Terms
The Tune Talk Goodies program includes the following categories of Goodies, each subject to the following specific terms:
Mobile Internet Goodies
Mobile Internet Goodies provide a specified data allowance for use during the Validity Period. Available data amounts, point costs, and Validity Periods vary based on the Goodie selected, as outlined in the App.
Subscribers are responsible for monitoring their data usage. Once the data allowance is exhausted, or the Validity Period expires, whichever occurs first, data access will be subject to the Subscriber’s underlying tariff plan rates.
Specific 120GB Data Goodie Terms: For the 120GB Data Goodie, the data allowance is provided in monthly installments of 10GB for a total of 12 months (365 days). Unused data from each monthly installment will not roll over to the subsequent month and will be forfeited.
Tune Talk reserves the right to manage network resources and may implement traffic management policies to ensure fair access to the network for all users.
The example of this Mobile Internet Goodies includes 300MB, 2GB, 8GB and 120GB data.
Social & Communication Goodies (Unlimited Social)
Unlimited Social Goodies provide unlimited access to specified social media applications (e.g., Instagram, Twitter, Facebook, Facebook Messenger) during the Validity Period. A list of supported applications will be available in the App.
Access to applications not explicitly listed as supported is not included in the Unlimited Social Goodies and will be subject to the Subscriber’s underlying tariff plan rates.
Tune Talk reserves the right to implement a Fair Usage Policy (“FUP”) for Unlimited Social Goodies to prevent abuse or excessive usage that may negatively impact the network or other users. Usage exceeding the FUP may be subject to speed throttling or other limitations, as determined by Tune Talk.
Validity Extension Goodies
Validity Extension Goodies extend the active validity period of the Subscriber’s Tune Talk account by the specified duration (e.g., 3 days, 1 year), commencing from the date of redemption.
Upon expiration of the extended validity period, the Subscriber’s account will enter a “Grace Period,” as defined in Tune Talk’s general terms and conditions. To maintain an “Active” status and avoid service interruption, the Subscriber must Top Up or Subscribe an Internet Plan to their account before the end of the Grace Period.
Tune talk Credit Goodies
Tune Talk Credit Goodies provide a specified amount of credit (e.g., RM5) to the Subscriber’s Tune Talk account.
The credit is subject to a Validity Period. Any unused credit will be forfeited upon expiration of the Validity Period.
The Tune Talk Credit can only be used to purchase other Tune Talk products or services and cannot be withdrawn as cash.
General Terms Applicable to All Goodies
Validity Period
Each redeemed product or service will be subject to a specific validity period as outlined in the redemption details. The validity period starts from the moment the product or service is activated or redeemed.
Forfeiture of Unused Balance
Forfeiture of Unused Balance:Once the validity period has expired, the redeemed product or service will no longer be available, and any unused portion will be forfeited. No extensions will be granted for unused portions.
Non-Transferability
Points, redeemed services, and products are non-transferable. Benefits received from redemption are personal for the subscriber and cannot be transferred, sold, or exchanged for cash or any other form of credit.
Account Suspension or Termination
In the event of account suspension or termination (for reasons such as non-payment or violation of Tune Talk’s terms), any redeemed products or services not yet used or expired will be forfeited. Subscribers will lose access to any remaining benefits upon suspension or termination.
Amendments to Terms and Conditions
Tune Talk reserves the right to update or amend these terms and conditions at any time, without prior notice. Updated terms will be communicated to subscribers through the official Tune Talk platform. It is the Subscriber’s responsibility to regularly review these Terms for any changes. Continued use of the Goodies program after any such changes constitutes acceptance of the revised Terms.
Liability and Limitations
To the maximum extent permitted by applicable law, Tune Talk shall not be liable for any interruptions, technical failures, or network issues that may prevent a Subscriber from redeeming or utilizing the Goodies. Tune Talk shall not be held responsible for any loss of points or service disruptions caused by network outages, force majeure events, or other unforeseen circumstances.
Customer Support
For any queries, issues, or concerns regarding the redemption process, validity, or these Terms and Conditions, Subscribers may contact Tune Talk Customer Support through the available support channels (phone, email, or the App).
Data Chargers and Additional Fees
For Mobile Internet plans, once the redeemed data allocation is used up, the subscriber will be subject to the regular data charges as per their plan. Extra charges may apply if the subscriber exceeds the allocated benefits (data, validity, social access, etc.) during the redemption period.
Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
